Welcome to our website. These Terms and Conditions (“Terms”) govern the provision of interior lining, plastering, and related trade services, as well as quotes, orders, and the use of our website. By requesting a quote, engaging our services, or browsing our website, you (“Client”, “you”) agree to be bound by these Terms and applicable Queensland and Australian laws.
1. Quotes and Acceptance
Validity: Unless otherwise specified in writing, quotes provided by Apex Interior Linings remain valid for 30 calendar days from the date of issue.
Acceptance: A quote is accepted, and a binding contract formed, when you accept the quote in writing, pay a required deposit, or authorize us to commence work on site.
Variations: Any changes, additions, or structural variations to the original scope of work requested by the client or necessitated by site conditions will be quoted separately and added to the final contract price.
2. Pricing and Payment
Currency: All prices are quoted in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless explicitly stated otherwise.
Payment Terms: Payment must be made in accordance with the payment schedule set out in our quote or invoice. Default terms for non-account clients are payment upon milestone completion or completion of works.
Trade Accounts: Approved trade account holders must settle accounts within the agreed credit terms (e.g., 30 days from invoice date).
Queensland Security of Payment: Progress payments and claims are made pursuant to the Building Industry Fairness (Security of Payment) Act 2017 (Qld). Failure to pay on time may result in interest charges, suspension of works, or legal recovery action.
3. Site Access and Work Conditions
Access: The Client must provide clear, safe, and uninterrupted access to the site for our personnel, vehicles, equipment, and sub-contractors during agreed working hours.
Preparation: The Client must ensure the site is structurally sound, clear of debris, and adequately prepared (e.g., framing straight and ready for lining) prior to our commencement, unless site preparation forms part of our agreed scope.
Delays: Delays caused by lack of site access, unready preceding trades, or unsafe site conditions may incur additional costs or extend completion timeframes.
4. Defects and Workmanship Guarantee
Standards: All plastering and lining work will be carried out in a professional, workmanlike manner in accordance with the National Construction Code (NCC) and relevant Australian Standards (including AS/NZS 2589 for gypsum linings).
